THE GRAND PARIS EVOLVES & UNVEILED 17 NEW INTERMUNICIPAL EMERGED IN LARGE CROWN

USPA NEWS - After over a year of exchanges with relevant large crown territories and their elected Jean-François Carenco, Prefect of the Ile-de-France, Prefect of Paris, welcomes the creation at 1 January, 17 new public inter-municipal cooperation (EPCI) with their own tax, from the regional pattern.

ALL FACILITIES PROVIDED BY THE REGIONAL PATTERN WERE CREATED ON 1 JANUARY 2016 After eight meetings held between September 2014 and October 2015, elected the regional commission component of intermunicipal cooperation (RCCI) examined 50 proposed amendments to the draft plan originally proposed by the regional prefect. Five of these amendments were adopted by the RCCI and the amended scheme was arrested March 4, 2015. "This regional pattern reduces the number of EPCI in the urban unit of 41-17, creating ambitious consolidation and the conditions for a balanced dialogue between the future Grand Paris and territories of the large crown" says the Regional Prefect, Jean Francois Carenco, After the development phase, all the perimeters of the new intermunicipal are now stabilized: all orders of creation of these new EPCI were taken by the prefects of the departments concerned before 31 December 2015. None of those arrested creation has been challenged at this stage by the administrative judge, yet seized for 4 sectors.

THE LEGAL ACTIONS ENGAGED ON GOVERNANCE IN 3 PERIMETERS : EPCI--------------------------------------------- 3 EPCI concerned by these appeals are: “¢ EPCI resulting from the merger of CA-Senart Val de Seine and the CA Val d'Yerres (Essonne); “¢ EPCI resulting from the merger of CA Evry Centre Essonne, Seine Essonne, in Essonne Sénart Sénart (Essonne and Seine-et-Marne) “¢ EPCI and resulting from the merger of CA Val-de-France and Roissy Porte de France with 17 municipalities in the CC Plains and mountains of France (Val-d'Oise and Seine-et-Marne). 2 of 3 decrees on the governance of these areas have already been suspended by the administrative court, not on procedural grounds but because the judge questioned the constitutionality of the law, as an it determines the composition of the community council (their creation is confirmed, only their mode of governance is disputed). Note that for the last perimeter CA Val-de-France and Roissy Porte de France and 17 municipalities of the CC Plains and mountains of France (Val-d'Oise and Seine-et-Marne), the Paris Administrative Court on hearing litigation on 6 January. First instance courts and before the Council of State who sovereignly decide or not to transmit the case to the Constitutional Council, who will judge him on the validity of this governance under the constitution.

IN THE MEANTIME THE EPCI WORK REGULARLYҬ--------------------------------------------------------------------------------By then, new EPCI must be able to function normally. This is the priority of the regional prefect, who has sent today a letter to the presidents of EPCI and mayors concerned to clarify their transient operating conditions provided for in paragraph V of Article L.5211-41- 3 of the General local Authorities Code: "The mandate of the members in office before the merger of public inter-municipal cooperation is extended until the installation of the new legislative body later than the Friday of the fourth week following the merger. The chairmanship of the institution resulting from the merger is a transitional basis, provided by the older of the presidents of public institutions merged. " During this period, the powers of community councils will be limited to acts of administration and urgent conservatory. In order to achieve the regional pattern of intercommunal cooperation intended by Parliament and approved by the elected component CRCI Paris region, the regional prefect appeal to overtaking communal selfishness, and the necessary dialogue between elected new EPCI.
